President Ibrahim Mohamed Solih has urged all state powers to refrain from any activity that interferes with the Government's smooth running. He stated this in a press statement released in the President’s Office website today.

Article 115 (a) and (c) of the constitution stipulates that the faithful implementation of the provision and laws of the constitution, the promotion of compliance by institutions of the state and the people, and the promotion of rule of law and the protection of rights and freedom of all people, are the responsibilities of the President.

The fundamental principle enshrined by the constitution is that all powers of the state are derived by the will of the people. These powers, as constitutionally stipulated - are to be executed, on behalf of the people, by the three separate branches of the state. Furthermore, the independence of the independent institutions established by the constitution is guaranteed by this very constitution. The powers and institutions established by the constitution have been structured in such a way as to prevent the dominance of one over the other.

While the Judicial Services Commission is one such constitutionally mandated institution, the constitution clearly demarcates how it’s procedures and decisions can be held accountable. This is done by the summoning of JSC members to the Parliament for questioning, followed by any required subsequent Parliamentary action. While this is the procedure mandated by the constitution, any other means of action taken by any other branch of the state will not be permitted by the constitution.

As such, the President appealed to all institutions of the state to respect the constitution by refraining from carrying out any action which may infringe the established system of governance.

While judicial reform is a fundamental pledge of this Government’s, the President took this opportunity to assure the people that all measures to fulfill this pledge are being carried out. The President further assured that as the head of state, he will not back down from upholding the principles and regulations mandated by the constitution.
